TERMS AND CONDITIONS: Attendance at Event

THIS IS A LEGAL AGREEMENT BETWEEN LTX EXPO INC, KNOWN AS LTX ("ORGANIZER") AND YOU. THIS AGREEMENT GOVERNS YOUR TICKET AND ATTENDANCE AT WHALE LAN (“EVENT”) , ALSO REFERRED TO AS “THE LAN PARTY” OR “COMPUTER GAMING EVENT” ON NOVEMBER 28, 2026 TO NOVEMBER 29, 2026, AMONG OTHER MATTERS.

THE TERM “HOSTS” OR “ORGANIZER” INCLUDES, BUT IS NOT LIMITED TO THE SPONSORS, EVENT STAFF, EVENT SITE PERSONNEL, AND OTHER PERSONS.

IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS (THE "TERMS" OR "AGREEMENT"), YOU ARE NOT AUTHORIZED TO ATTEND THE EVENT; ATTENDING THE EVENT CONSTITUTES YOUR AGREEMENT AND INTENT TO BE BOUND BY THESE TERMS.

THE PHYSICAL LOCATION OF THE LAN PARTY IS HELD AT: 9755 190 ST, SURREY, BC V4N 3M9

 

ATTENDANCE

1. Your participation in the Event is at your own cost and expense.
2. You assume all risks related to your attendance at the Event, including the risk of bodily injury, illness, death, property damage, or other loss arising from your attendance at the Event.
3. All participants must act in a professional, respectful, and lawful manner at all times. Alcohol, cannabis, and illegal substances may not be consumed at the Event, except as expressly permitted in writing by the Organizer.
4. Participants must not engage in conduct that is unsafe, disruptive, harassing, discriminatory, excessively noisy, or otherwise detrimental to the Event or the enjoyment of others.
5. Sales, solicitations, or promotional activities are limited to assigned Space and require the Organizer's express prior approval.
6. All participants must comply with Organizer rules, venue policies, and applicable law, as updated from time to time.
7. The Organizer may, in its sole discretion and without refund, restrict, modify, or remove any participant, activity, or material deemed objectionable, unsafe, unlawful, or inconsistent with the standards or image of the Event.
8. Participants will conduct themselves in a professional and sportsmanlike manner.
9. Participants will be respectful of each other’s person and equipment.
10. Your attendance, participation, and involvement at the Event is at your own cost and expense. The Organizer may, in its sole discretion, remove you from the Event if you are disruptive, a nuisance, hinder others' enjoyment, or breach this Agreement. Alcohol, cannabis, and illegal substances may not be consumed at the Event, except as expressly permitted by the Organizer.

CONTENT + PROGRAM CHANGES

The Organizer reserves the right, in its sole discretion, to change any aspect of the Event, including the name, program, themes, content, speakers, hosts, moderators, venue, or schedule.

The Organizer is not responsible for any inaccurate information, whether caused by any of the equipment or programming associated with or utilized in the event or by any technical or human error which may occur in the processing of tournament results.

If for any reason tournaments are not capable of running as planned, including infection by computer virus’, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the WHALE LAN Administrator’s / Sponsors which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the tournaments, WHALE LAN Administrators / Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend tournaments without refund.

CHEATING

WHALE LAN has a zero tolerance for cheating. Cheats include, but are not limited to: cheat codes, exploits, debug version game kernels or libraries, excessive ping of network devices or computers to slow network bandwidth. If you are caught cheating during any tournament match, it will result in the forfeiture of the game, and disqualification from all remaining tournaments/games and possible removal from the site.

HACKING

WHALE LAN does not tolerate hacking of any kind under any circumstance. Hacking of computers, network devices, DoS attacks, viruses, backdoors or anything of the sort is grounds for immediate dismissal from WHALE LAN without refund and can lead to banning said player from all future events.

OFFICIALS

WHALE LAN officials along with Sponsors execute all facets of the LAN and Tournaments.

WHALE LAN Administrators and Sponsors reserve the right to require any Participant to replay any match for any reason, at their sole discretion and to disqualify any participant who fails to follow the Official Rules, who makes any misrepresentation relative to the Tournament and/or the redemption of prizes, who tamper with the entry process or the operation of the Tournament or Web Site, who acts in violation of the Official Rules, who acts in an unsportsmanlike or disruptive manner or who acts with intent to annoy, abuse, threaten or harass any other person(s). To ensure that players have played according to the Official Rules, Tournament Officials will review ALL game play during the Tournament. Decisions by Tournament officials are FINAL. All prizewinners will be identified on site at the Event.

ACTS OF VIOLENCE

Acts of violence will NOT be tolerated. Intentional damage to the property, other guest's computers, staff property, network equipment, and items belonging to sponsors, is grounds for immediate removal from the event without refund. The WHALE LAN staff reserve the sole right to define what is and what is not a violent act. No weapons of any kind are allowed at WHALE LAN, this includes play toy weapons, paintball markers, Airsoft guns, etc.

ILLEGAL ACTIVITIES

WHALE LAN does not, under any circumstances condone any type of illegal activity whatsoever, including but not limited to the copying of illegal software, MP3's or distribution of pornographic material to minors. WHALE LAN Staff / Admins do not condone pirating; however we cannot and will not police machines and network traffic trying to find such items. Each individual is solely responsible for the software / files and the copyright laws associated with items that are located on their machine. In addition WHALE LAN has a firm policy against viewing pornographic material at our events. Please be aware that making pornographic material viewable and or accessible to minors is illegal. If a staff member views pornography displayed on your computer at any time, you will be removed from the event without refund.

Participants understands that their machines(s) are their personal responsibility and liability and agrees to indemnify, defend and hold harmless LTX Expo / WHALE LAN / Linus Media Group Inc / Staff / Hosts / Sponsors and each Sponsor's directors, officers, employees, agents and representatives from any claims arising out of, in whole or in part, the participant's use in any way of his/her computers, monitor, or other computer related equipment during a WHALE LAN.

FEES + PAYMENT

Any applicable fees for tickets or passes for the Event must be paid upon registration. If payment is insufficient or declined, the Organizer may refuse admission without liability. All fees are strictly non-refundable, except as required by Applicable Law.

DOOR PRIZE DRAWING

All general door prize drawings organized by the event administrators are open to ticket holders attending WHALE LAN. A person is eligible for only one door prize draw entry. The ticket owner must be present to win. A person can win up to one time.

PRIVACY, PHOTOGRAPHY + MEDIA

You irrevocably grant the Organizer and its representatives permission to photograph, film, and record you at the Event, and to use, reproduce, and distribute your image, likeness, or voice in any format now known or later developed, worldwide, in perpetuity, without compensation. You waive all moral rights therein. Third-party ticketing and registration providers (e.g., Shopify) may have their own privacy policies, which apply independently of this Agreement.

LIMITATION OF LIABILITY + INDEMNITY

1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ORGANIZER SHALL NOT BE LIABLE TO YOU FOR ANY FINANCIAL LOSS OR DAMAGES WHATSOEVER, INCLUDING INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF BUSINESS OR GOODWILL, WORK STOPPAGE, LOSS OF DATA, OR LOST PROFITS, ARISING OUT OF OR IN CONNECTION WITH THE EVENT OR THIS AGREEMENT. ORGANIZER'S TOTAL LIABILITY SHALL NOT EXCEED $1.00.
2. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS ORGANIZER, ITS DIRECTORS, STAFF, VOLUNTEERS, AND AGENTS FROM ANY CLAIMS, DEMANDS, LOSSES, OR COSTS (INCLUDING LEGAL FEES) ARISING FROM YOUR ATTENDANCE OR PARTICIPATION AT THE EVENT
   

INTELLECTUAL PROPERTY

All intellectual property rights in and to the Event, its content, and materials distributed in connection with the Event are owned or licensed by the Organizer. You may not reproduce, use, or distribute any such content or marks without the Organizer's prior written consent.

MINOR CURFEW

All unescorted minors must leave the WHALE LAN at 10:00 PM and cannot return until 7:00 AM. This applies to any person under the age of 18 if their parent / guardian is not present. There will be no exceptions to this curfew. Failure to follow the curfew will result in immediate removal from the LAN without refund and barred from any future events.

GENERAL + MISCELLANEOUS

1. Relationship. This Agreement shall not be construed as creating any partnership, joint venture, employment relationship, or agency between you and the Organizer. No party shall be deemed the legal representative of the other, nor shall any party represent itself as having authority to act for or bind the other, except as expressly provided herein.
2. Interpretation. Unless the context otherwise requires, words importing the singular include the plural and vice versa, and words importing gender include all genders. The word "or" is not exclusive and "including" is not limiting, whether or not followed by "without limitation" or similar words. This Agreement shall be construed as a whole and neither strictly for nor strictly against any party.
3. Governing Law + Jurisdiction. This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein. You agree to attorn to the exclusive jurisdiction of the courts of British Columbia. This Agreement ensures to the benefit of and is binding upon the parties and, except as otherwise provided or inconsistent with its provisions, their respective heirs, executors, administrators, successors, and permitted assigns.
4. Severability. If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
5. Notice. Any notice or communication required or permitted under this Agreement shall be in writing and delivered personally, sent by mail, courier, or email to the address provided at registration (or as otherwise notified in writing). Delivery shall be deemed effective on the day delivered, if by hand or email, and within four business days if mailed.
6. Entire Agreement. This Agreement (including any supplemental rules or regulations issued by the Organizer) constitutes the entire agreement between the parties with respect to the Event and supersedes all prior communications, representations, and agreements, whether written or oral.
7. Assignment. You may not assign or transfer any of your rights or obligations under this Agreement without the Organizer's prior written consent. The Organizer may assign this Agreement without your consent in connection with a sale, merger, transfer of assets, or to an affiliate.
8. Counterparts + Electronic Agreement. This Agreement may be executed in counterparts, each of which is deemed an original, together constituting one and the same instrument. Delivery by electronic means (including email, facsimile, or clickwrap acceptance) constitutes valid execution and delivery.
9. Venue Policies. You must comply with all Smash Champs Badminton Center rules, at your own cost and expense, applicable to your attendance, conduct, or activities and reimburse the Organizer for any resulting fines, charges, or costs caused by your breach.

VOLUNTEERS

If you are also a Volunteer to or for the event, then:

1. You are not an employee, contractor, or agent of Organizer and are not entitled to wages, benefits, or other compensation.
2. Any perks offered (e.g., admission, meals, merchandise) are discretionary.
3. Volunteers must act professionally, comply with Organizer instructions, venue rules, and applicable law, and refrain from harassment, unsafe conduct, or substance use.
4. Volunteers acknowledge and assume all risks of volunteering and release Organizer, its directors, staff, and volunteers from liability for injury, illness, loss, or property damage.
5. The Organizer may terminate a Volunteer's participation at any time if the Volunteer breaches this Agreement or engages in conduct deemed inappropriate, unsafe, or inconsistent with the Event.

These Terms & Conditions, Waiver of Claims, Assumption of Risks, and Release of Liability Agreement (this “Release”) is executed at the time of application submission by the volunteer applicant (“I” or “me”) in favour of LTX Expo Inc., a corporation incorporated and existing under the laws of the province of British Columbia and its affiliated companies, directors, officers, employees, volunteers and agents (the “Organization”).

I desire to volunteer for the Organization and engage in activities related to being its volunteer (the “Activities”) I understand that the Activities may include, but are not limited to, participation in WHALE LAN, including related activities, on or about November 28, 2026 To November 29, 2026 (collectively, the “Program”).

I understand that as a volunteer, I will receive no compensation or remuneration for my services and will not be eligible for any employee benefits. I acknowledge that I am not an employee of the Organization.

In exchange for being allowed to participate in the Activities and the Program as a volunteer and for other good and valuable consideration, the receipt and sufficiency of which I acknowledge, I hereby freely, voluntarily and without duress or undue influence, execute this Release and agree to the following terms:

1.         Assumption of Risk: I understand participating in the Activities and Program involves inherent risks and dangers, and may expose me to a variety of foreseen and unforeseen hazards and risks, including the risk of injury, such as the potential for permanent paralysis and death, as well as damage to or loss of property. I acknowledge that I am voluntarily participating in the Activities and the Program and have considered these risks. I hereby expressly and specifically assume such risks, including any and all risk of injury, harm or loss that I may incur as a result of my participation in the activities, even if such injury, harm or loss arises from the negligence of the organization; and

2.         Medical Treatment: I hereby give consent and authority to the Organization to obtain medical treatment on  my behalf if I am injured or require medical attention during my participation in the Activities. I understand and agree that I am solely responsible for all costs related to such medical treatment, medical transportation, and/or evacuation. I hereby release, forever discharge and hold harmless the Organization from any claim whatsoever in connection with such treatment or other medical services.

3.         Release and Waiver: I hereby fully and forever release and discharge the Organization from, and expressly waive, any and all liability, claims and demands of whatever kind or nature, either in law or in equity, that may arise from my participation in the Activities. I agree not to make or bring any such claim or demand against the Organization, and fully and forever release and discharge the Organization from liability under such claims or demands.

I UNDERSTAND THAT THIS RELEASE DISCHARGES THE ORGANIZATION FROM ANY LIABILITY OR CLAIM THAT I MAY HAVE AGAINST THE ORGANIZATION WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR PROPERTY LOSS THAT MAY RESULT FROM THE ACTIVITIES, WHETHER CAUSED BY THE NEGLIGENCE OF THE ORGANIZATION OR OTHERWISE.

4.         Insurance: I understand that workers' compensation or other insurance is not available to volunteers and that the Organization does not provide workers' compensation insurance for volunteers. I expressly waive any claim for compensation or liability on the part of the Organization in the event of any injury or medical expense.

I UNDERSTAND THAT THE ORGANIZATION DOES NOT ASSUME ANY RESPONSIBILITY FOR, OR OBLIGATION TO PROVIDE, FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE OF ANY NATURE IN THE EVENT OF MY INJURY, ILLNESS, OR DEATH, OR DAMAGE TO OR LOSS OF MY PROPERTY.

5.         Photographic Release: I understand and agree that during the Activities and the Program, I may be photographed or videotaped, or both, by the Organization for internal and promotional use. I hereby grant and convey to the Organization all right, title and interest, including but not limited to, any royalties, proceeds, or other benefits, in any and all such photographs or recordings, and consent to the Organization's use of my name, image, likeness, and voice in perpetuity, in any medium or format, for any publicity without further compensation or permission.

6.         Miscellaneous: I hereby agree that this Release represents the full understanding between the Organization and me and supersedes all other prior agreements, understandings, representations, and warranties, both written and oral, between us, with respect to the subject matter hereof. If any term or provision of this Release shall be held to be invalid by any court of competent jurisdiction, that term or provision shall be deemed modified so as to be valid and enforceable to the full extent permitted. The invalidity of any such term or provision shall not otherwise affect the validity or enforceability of the remaining terms and provisions. This Release is binding on and ensures to the benefit of the Organization and me and our respective heirs, executors, administrators, legal representatives, successors, and permitted assigns. Section headings are for convenience of reference only and shall not define, modify, expand or limit any of the terms of this Release.

7.         Governing Law: I agree that this Release shall be governed by and construed in accordance with the laws of the province of British Columbia. Any disputes that arise out of or relating to this agreement shall be subject to the exclusive jurisdiction of the courts located in British Columbia.

BY SUBMITTING AN APPLICATION TO VOLUNTEER, I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS RELEASE INCLUDING THE RIGHT TO SUE THE ORGANIZATION.
